It also means Durkin has the right to all records related to Pangea, including correspondence among attorneys who have represented the company and Bergstein in the matter. Many of those communications have been kept under cover because of attorney-client privilege until now. An attorney for Tutor is said to have the Pangea records, which until now he has refused to turn over to the trustee. Tutor had said if Bergstein were removed as manager of Pangea, which is now the case, that he would sue for $2.5 million. That apparently relates to the amount of a loan held by a bank relating to the movie Father of Invention. Tutor apparently guaranteed that much of the cost of making and releasing that movie. The movie, starring Kevin Spacey, was released direct to video in October. The judge noted that threat and said in court that under bankruptcy law, Tutor would have no right to file such a suit now that he has issued a formal order placing Pangea under Durkin's control. This does not affect the judge's earlier ruling by which Aramid Entertainment Fund and other creditors are preparing their own plan for how to reorganize these businesses. That proposal is still due by Jan. 2. What this does do is strengthen Durkin's position as the trustee and allow him to move forward on tracking down millions in missing assets. Exhibit A in the case for Rachel McAdams to stop and seriously re-evaluate the direction of her career: The trailer that incited this intervention. Please stop. This is the second amnesiac romantic drama character you’ve played, who, over the course of a movie, must fall back in love with your husband. (Sure, most of the memory loss in The Notebook was left to Gena Rowlands, who played your older counterpart, but still!) One amnesia-torn love story is enough. It is not just that, though. It is McAdams’s humdrum choices ever since 2004’s The Notebook and 2005’s Wedding Crashers, both of which pitted the actress in the kind of role she has never strayed far from: Charming upper middle class white girl love interest. To her credit, McAdams has tested different genre waters (albeit unsuccessfully). There was the plane thriller Red Eye, the cancer holiday picture The Family Stone, the period drama Married Life, the army road movie The Lucky Ones, the political thriller State of Play, the adapted romance The Time Traveler’s Wife, the blockbuster Sherlock Holmes: A Game of Shadows and the Woody Allen movie Might in Paris. Unfortunately, in spite of these wide-ranging genres and the potential stage they each offered McAdams to break out of her shell and play anyone other than a distant Allie Hamilton relative, McAdams seems to reiterate the same character repeatedly. Granted, some actresses have been able to mine successful careers out of that no-range formula if they (or their managers) have an eye for blockbusters. Case in point: Katherine Heigl, who always plays Katherine Heigl, and until The Killers, enjoyed box office popularity because of her keen guilty pleasure picks in Knocked Up, 27 Dresses and The Ugly Truth. But post-Notebook McAdams has neither given us films that audiences care to see (unless she is in a supporting role) or powerful dramatic performances that have established her as anything but a rom-com star who can score big at the box office with the right co-star. I root for McAdams, and I hope that she can eventually prove her range as an actress that viewers once expected great things from. Please Rachel, stop whiffing at the plate with rom-coms and start giving viewers the kinds of performances they expected from you after seeing Mean Girls. There is a glimmer of hope…the upcoming Untitled Terrence Malick project to which McAdams is attached with Jessica Chastain, Ben Affleck, Rachel Weisz and Javier Bardem. The drama may sound like a formulaic rom-com — it “centers on a man who reconnects with a woman from his hometown after his marriage to a European woman falls apart” — but at this point, I’ll trade in any of her 2005 to 2011 credits for a well-directed Rachel McAdams romance…or if I can’t have that, short-term amnesia.

Lou Maletta dies at 74

Lou Maletta, who gave visibility and voice to the AIDS crisis and gay and lesbian issues as the founder of the Gay Cable Network, died of liver cancer on Nov. 2. He was 74. A mix of talkshows, news and cultural programming and sex-themed fare, his network had a 20-year run of original programming, which "demonstrated enormous staying power in an adverse commercial and social climate for gay content," wrote Andy Humm, the host of the show "Gay USA," the successor to weekly series that started on Gay Cable Network in 1985. Humm wrote in Gay City News that "long before 'Ellen,' Logo, out gay news anchors and the rise of the Internet, Maletta was reaching hundreds of thousands of LGBT people hungry for representations of themselves and news about the burgeoning movement." As cable TV expanded throughout the country, Maletta capitalized on the availability of leased-access channels. He started a show in upstate NY called "Men and Films," in which he edited pornographic films for a wider audience. His ambitions soon expanded into other programming, much of it centered in Manhattan but distributed to 20 other cities, as AIDS became an epidemic. What motivated Maletta, Humm said in an interview, was watching a 30-year-old friend turn into someone who looked 90 after being diagnosed, Maletta told Gay City News in 2009. "No one had seen a KS lesion on TV until we put it on cable." By 1984 the network was covering politics, not just in NY but nationwide, and sent crews to the political conventions of both parties that year. Humm remembers he and others trekking to the conventions and interviewing any politician they could, asking questions about the AIDS epidemic and gay and lesbian issues that were not getting play in the mainstream media. Among those who were queried were George W. Bush, Strom Thurmond, Ann Richards and Bob Dole. Dole was asked whether there was "a place for gay people in the Republican party," Humm recalled. He responded, "Maybe somewhere." Maletta "had this philosophy that we could do something important for the community if we were on TV," Humm said. "That is still very important, even with the Internet." Maletta didn't fulfill a goal of creating a 24-hour gay cable network, but in 2005, Viacom launched Logo, aimed at a gay and lesbian audience. In his later years, after he retired in 2001 and closed the network, Maletta sought a home for the extensive archive of 6,000 hours of programming, which eventually landed at NYU's Fales Library. Van Duren's latest, co-written by crime-pic specialist Paul Jan Nelissen ("Godforsaken"), doesn't shy away from the period's violence and poverty, though it's hard to see the film as a docu-like corrective, since it, too, traffics in familiar cliches; "Gang" at times feels like a Prohibition-set drama that took a wrong left turn and ended up among the windmills. Story is largely set in Oss, a midsized industrial town in the devoutly Catholic province of North Brabant, bordering Belgium. The soot-covered workers' town is ruled by a violent gang of thugs who congregate in the bar of Johanna (Sylvia Hoeks), who not only pours a stiff drink but occasionally satisfies gang members upstairs (her nickname is "Johanna the Slut"). Narrative proper gets rolling when Johanna's hubby, the scowling Ties (Flemish thesp Matthias Schoenaerts), is released from prison, and Johanna reveals she wants to turn their watering hole into a restaurant -- the screenplay's not very subtle way of telegraphing that the pretty gal has a mind of her own and wants to better her life. But the schematic screenplay isn't much more insightful than that. Ominously mustachioed mob boss Wim (Marcel Musters) sticks to his guns, while some gang members insist they'll leave their life of crime behind and go abroad. This simplistic binary -- should I stay or should I go? -- stifles any opportunity for character development or exploration of moral gray zones. By pitting the baddies as lapsed Catholics who fight the Protestant law-enforcers from the faraway Hague, forgiveness and redemption seem but a Hail Mary away, further defusing the tension. Supporting characters, including a lecherous local priest (Jaap Spijkers) and a sex-addict industrialist (Pierre Bokma), are also mere stick figures, though thesping, in the Brabantic accent, is generally fine. Pic seems unsure how to balance the story of the gang, whose inner workings remain vague, and their numerous exploits with the sexy but narratively tangential Johanna, who is pushed centerstage several times but never becomes a conduit for any larger underlying themes. Impressive period re-creation by production designer Dirk Debou and costume designer Manon Blom is aces. Equally enervating as spectacle and history lesson, this war epic exemplifies the sort of depressingly committee-driven filmmaking presently in vogue on the mainland, though poor local returns (pic opened Sept. 23 with a three-day $1.8 million) suggest that, after "The Founding of a Republic" and "Beginning of the Great Revival," Chinese audiences are losing their appetites for star-studded, po-faced propaganda. While Jackie Chan's marquee presence could boost the film's profile in the West, crossover potential looks as limited as usual for this type of fare. Co-directed by lenser-turned-helmer Zhang Li and Chan (credited as general director), "1911" was commissioned to honor the centenary of the Xinhai Revolution led by Sun Yat-sen and his military deputy Huang Xing, ending an era of Chinese monarchy and feudalism. In re-creating the crumbling opulence of the waning Qing dynasty and the heavy-duty firepower of the 1911 uprisings at Guangzhou and Wuchang, the filmmakers have spared little expense with their physically imposing vision of this chaotic and violent period (which directly precedes the birth of the Communist Party recounted in "Beginning of the Great Revival"). But the script by Wang Xingdong and Chen Baoguang (who co-wrote "Founding of a Republic") is unable to shape these events into a coherent narrative, or to present a stirring depiction of the revolutionary fervor sweeping through China. Resulting mish-mash of exposition and speechifying opts to summarize rather than dramatize; one spends nearly as much time reading indigestible lumps of onscreen text as one does listening to the often distractingly post-dubbed dialogue. Providing an anchor of sorts is the relationship between Sun (Winston Chao) and Huang (Chan), who lead the Tongmenghui resistance movement on two different fronts. While Sun spends much of the film abroad, rallying financial support from Chinese expats and laying diplomatic foundations for a new republic, Huang is an active fighter at home, losing some fingers in the failed Guangzhou uprising and, for reasons ill explained here, pretending to be the husband of resistance member Xu Zonghan (Li Bingbing). A proper portrait of how this phony union flowers into a real marriage is one of many onscreen casualties here; when Xu mentions sometime later that she's carrying Huang's child, you wonder if you've missed a paragraph of plot somewhere. While the filmmakers have clearly marshaled their resources on a grand scale, they haven't figured out a workable, let alone intelligent, dramatic strategy; individual sequences seem to halt midway through, giving the impression of a pageant with intermittent bursts of movement rather than a sustained piece of moviemaking. The disjointed editing scheme frequently pauses for monochrome slo-mo interludes or idyllic flashbacks of martyred hero Lin Juemin (Hu Ge) running along the beach, all accompanied by unsubtle violin plucking. Much of the film's midsection is devoted to a bloody restaging of the Wuchang uprising, as the resistance gains the upper hand but winds up in a protracted stalemate with the armed forces commanded by shrewd tactician Gen. Yuan Shikai (Sun Chun). The scenario does possess a layer of interest in its examination of economic underpinnings, as the impoverished Qing court finances its advanced weaponry by ceding large sections of China to foreign imperialists, auctioning off its sovereignty to wage war against its own people. The republic's fragile beginnings in 1912, as Sun Yat-sen returns to China and negotiates with Yuan to force the abdication of the Qing empress (Joan Chen) and her young heir, similarly provide flickers of dramatic life far too late in the game. Chan is fine but colorless as Huang, breaking character at one point to indulge in a wink-wink martial-arts display; Chao makes Sun Yat-sen (a role he's essayed many times before) a figure of estimable dignity and decency; and Sun Chun impresses as the dangerously unpredictable Yuan. The three are surrounded by an enormous cast of bit players and extras, many identified with onscreen titles that seem at once meticulous and arbitrary. The most cringe-inducing of the real-life personalities here is American adventurer-author Homer Lea, trotted onscreen every so often to utter gee-golly exclamations ("You're making history!") presumably for the benefit of a Western audience. The mealy-mouthed fadeout dutifully extols the virtues of revolution as a force that "seeks eternal happiness for everyone in the world," gingerly sidestepping the decades of war, famine and slaughter that will follow under different but no less misguided regimes. L-Word Star Kisses Girl, Gets Escorted Off Plane

-- A lesbian actress who starred in The L-Word said she kissed a girl and got escorted off of a Southwest Airlines flight on Monday for doing it. Leisha Hailey took to Twitter to call for a boycott of the carrier after a flight attendant told them other passengers had complained after witnessing the affection. Her first tweet said: I have been discriminated against. She later added, Since when is showing affection to someone you love illegal? Southwest responded on its website that Hailey was approached based solely on behavior and not gender. The airlines four-sentence response said passengers were characterizing the behavior as excessive. A discussion followed on the flight, and the airline said it escalated to a level that was better resolved on the ground. Hailey was a musician before joining the cast of the Showtime drama featuring the lives of lesbian friends and lovers living in Los Angeles. She played the character Alice Pieszecki. The actress and her unidentified girlfriend were on a flight from Baltimore to St. Louis. The kissing occurred in the air and a discussion followed when the plane landed. Hailey said the encounter between the couple and a flight attendant was recorded. A message seeking comment from Halleys spokeswoman Libby Coffey was not immediately returned. The Southwest website says it is the official airline of the Gay & Lesbian Alliance Against Defamation. Richard Ferraro, a spokesman for GLAAD, did not immediately return a call seeking comment. Earlier this month, the airline kicked off Green Days lead man Billie Joe Armstrong for wearing his pants too low. The Grammy winner was escorted off a plane after failing to follow a flight attendants directive to pull the pants up. Southwest also removed director Kevin Smith from a flight last year because he didnt fit properly in a single seat. Beverly Hills, CA More than 115 images shot on the sets of such films as Raging Bull, Munich, You, Me & Dupree, Rendition, Salt and Superman Returns will be on display in the Academy of Motion Picture Arts and Sciences new exhibition, Crew Call 2011: Celebrating the Crafts, opening Friday, September 9, in the Academys Grand Lobby Gallery. The exhibition, open to the public, will run through Sunday, December 18. Admission is free. Shot by 25 members of the Society of Motion Picture Still Photographers, Crew Call 2011 will include photographs depicting the work of numerous, and essential, ‘below-the-line’ craftspeople on a movie set, from animal wranglers, puppeteers, makeup artists, seamstresses, stunt performers and prop masters to grips, gaffers and P.A.s. Several images show how production design and visual effects departments work preparing sets and staging action sequences, and provide glimpses of how the magic of the movies is achieved during long days and nights of shooting. Lee excels at maintaining a wide spectrum of memorable, sharply delineated characters of different classes, advancing parallel storylines in which kings and generals scheme and double-cross, manipulating armies like chess pieces, while hapless conscripted peasants scramble to survive. After yielding disappointing Korean B.O. returns, "Heroes" caused the hitherto commercially successful Lee to announce his retirement (since recanted), but the film should shine on the fest circuit. A newly hatched war positions the small southern Korean state of Shilla in a dangerous alliance with China's Tang dynasty against the large northern state of Goguryeo, the film bitterly parodying North/South Korean relations in general and specific terms. One particularly hilarious scene sees the North Koreans catapulting live chickens, goats, pigs and cows over their ramparts into the bewildered South Korean camp in retaliation for the latter's disconcerting offer of rice (an absurdist reference to food relief). On the highest level, Shilla's sardonic young king (Hwang Jeong-min) follows the counsel of his wily old general (Jeong Jin-yeong), who, rightfully distrustful of their superpower ally, withholds his main forces -- the first strategic move in a long, cunning game against Tang treachery. On the northern side, Goguryeo's fearsome general (Lee Weon-jong) dies, but not before bypassing his eldest, diplomatically inclined son (Yun Je-mun) in favor of his martial second-born (Ryu Seung-ryong), thus setting brother against brother; it's the closest Lee ever comes to outright Shakespearean tragedy. But the helmer grants no inner conflict or humanity to the cold, villainous Tangs, united under a single autocratic general (Lee Dae-yeon). Among the groundlings, the pic finds its true antic hero in Thingy (Lee Mun-shik), a peasant so poor he doesn't own a name. A veteran of the earlier war chronicled in "Once Upon a Time in a Battlefield," Thingy instructs his countrymen in the fine art of staying alive -- by marching in place when others are advancing, for instance. Accidentally catapulted into the enemy stronghold, Thingy is persuaded to broadcast a heartfelt propaganda message to the southern army, expounding on the futility of war and the treachery of the Tangs; in exchange, he demands the hand of a feisty female warrior (Seon Woo-seon) in a subplot that plays like a coy feudal romantic comedy. All this transpires during sweeping epic battles in which mysterious secret weapons rain deadly projectiles upon formations of luckless soldiers. Lee creates brilliantly stratified storylines, each with its own level of satire, slapstick or tragedy, and sustains them through a convoluted mix of action and class distinctions. The fixed nature of the siege dictates that the two sides deploy ever more devious, desperate measures as rocks, fire, animals, vegetables and humans are catapulted back and forth. Despite the huge cast, each character is immediately recognizable, his role in the overall drama never negligible in the ingenious script by producers Jo Cheol-hyeon and Oh Seung-hyeon.
